What does it mean when a criminal case is Nolle Prossed? When a case is nolle prossed (formal term "nolle prossequi"), the Commonwealth has elected to dismiss the charge. The charge can be brought again one more time in the future, but for the moment, it's gone. This may be done by the prosecution in plea agreements involving multiple charges, in cases in which there is not sufficient evidence to convict, or in cases involving the potential for more serious charges.
